LOS ANGELES -- A trial will be held next month to determine whether Donald Sterling, who opposes his estranged wifes planned sale of the Los Angeles Clippers, was properly removed as an administrator for the family trust that owns the team. Mario Manningham . A probate court judge in Los Angeles Wednesday denied Shelly Sterlings urgent request to confirm her authority as sole administrator of The Sterling Family Trust so that she can unilaterally proceed with a $2 billion sale of the team to former Microsoft CEO Steve Ballmer. Instead, the judge agreed to an expedited hearing because of looming sales deadlines. The development is the latest in a legal tug-of-war following the NBAs decision to ban Donald Sterling for life after racist remarks to a girlfriend were recorded and publicized. Donald Sterling is fighting the decision and suing the league for $1 billion. The league has contended the comments were bad for business and damaged both the Clippers and the NBA. The four-day trial was granted exceptionally quickly and will begin July 7. The deadline for the sale is July 15, which also is the date the NBAs owners hope to vote on whether they will approve the sale. Court filings Wednesday indicated the NBA has set a hard deadline of Sept. 15. If the sale isnt completed then, the league will undertake proceedings to seize and sell the team on its own. Donald Sterlings lawyer, Bobby Samini, left the courthouse without comment after a clerk announced the trial schedule. Neither Sterling was present. "I just want to resolve this as quickly as possible," NBA Commissioner Adam Silver told The Associated Press on Wednesday in Miami at an NBA Cares event. The crux of the case will centre on the question of whether the 80-year-old Donald Sterling is mentally competent to be a co-trustee of The Sterling Family Trust, which gives him the authority to determine the teams future. According to the trusts terms, he can be ruled "mentally incapacitated" after being evaluated by two doctors, said Pierce ODonnell, Shelly Sterlings attorney. Shelly Sterling activated that clause in negotiating what would be a record-breaking deal with Ballmer as sole trustee. But Donald Sterling challenged the removal in a letter sent Monday to his wifes attorney said "any attempt to remove me as a Trustee of the Sterling Trust is invalid and illegal. Furthermore, any assertion that I am incapacitated... is false and without merit." According to court documents, two doctors examined Donald Sterling in May and concluded that he suffers from "mild cognitive impairment consistent with early Alzheimers Disease" or some other forms of brain disease after examining brain scans and having him undergo other tests. "In my opinion he is substantially unable to manage his finances and resist fraud and undue influence, and is no longer competent to act as trustee of his trust," concluded Dr. James E. Spar, who is affiliated with the division of geriatric psychiatry at UCLA. Sterling voluntarily went to the doctors at the request of his wife, according to a person with knowledge of the proceedings who spoke on condition of anonymity because they were not authorized to discuss the details publicly. A third doctor reviewed the two doctors findings as well as Sterlings brain scans and concurred with their conclusions that he "lacks the capacity to function as trustee." Donald Sterlings attorney, Maxwell Blecher, contested the doctors findings in remarks Tuesday to The Associated Press. "Anybody at his age level on a brain scan would probably show some impairment. But that doesnt mean you forget where your car keys are and youre incompetent," Blecher said. "There isnt the slightest evidence hes incapable of managing his affairs." Donald Sterling said in a statement that hes not just fighting for the Clippers but taking a stand against the NBA, which he called "a band of hypocrites and bullies" and "despicable monsters" who want "to take away our privacy rights and freedom of speech." "As Ive said previously, if Donald chooses to litigate against us, so be it," Silver said. "So its going to take longer than we had hoped for this transaction to close, but itll get done ultimately. Its just a question of time." Ballmers attorney, Adam Streisand, said he was pleased with the trial schedule and "confident that after the trial the court is going to bless this transaction." The NBAs general counsel, Rick Buchanan, warned in a court papers that if the judge didnt confirm Shelly Sterlings sole trusteeship and if her deal with Ballmer "is not promptly consummated, there will be substantial harm" to the Clippers, the NBA and even The Sterling Family Trust -- the last of which would be responsible for the NBAs costs related to the legal proceedings that result. Buchanan said a recent independent survey of more than 500 Clippers fans found the majority would be less likely to support the team if Donald Sterling remained its owner. Buchanan said thousands of NBA fans worldwide have contacted the league directly or via social media to say theyre hurt or embarrassed by his views and arent sure theyll continue supporting the league and its teams. He also cited NBA player worries about the impact for the team with the upcoming NBA draft. "Mr. Sterlings continued ownership is damaging the Clippers and NBAs relationships with existing and potential business partners and licenses," Buchanan wrote. He said nearly all of the Clippers local sponsors have terminated or suspended their relationships with the team, including Adidas, Commerce Casino and Hotel, Red Bull, Mandalay Bay Hotel, Virgin America and Mercedes. Shelly Sterlings court bid aims to have a judge confirm her authority as sole trustee to ensure the Ballmer sale moves forward. Blecher said that a representative for Donald Sterling would be at any hearing, and that the next step is to have other doctors evaluate Donald Sterling. "I have no doubt at the end of the day the court is not going to say hes incompetent," Blecher said. In Torontos last game before the NBA all-star break this weekend, DeRozan, who was named a reserve on the Eastern Conference team, scored 31 points -- including 14 in the third quarter -- to lead the Raptors over the Atlanta Hawks 104-83 on Wednesday. Raptors coach Dwane Casey says hes been pleased with his all-stars constant improvements. "Hes done a great job every year of getting better," Casey said. "I know he wont (get complacent), because hes such a conscientious (guy). Hes a basketball junkie. I dont see him taking time off this summer just because he made the all-star team." An investigation into the racially charged Miami Dolphins bullying scandal detailed widespread harassment in the teams locker room that extended beyond the two players at the centre of the probe. The NFL-ordered report stated there was a "pattern of harassment" committed by at least three players and extended to two lineman and an assistant trainer, all targets of vicious taunts and racist insults. Lawyer Ted Wells released the report Friday, saying guard John Jerry and centre Mike Pouncey followed Richie Incognitos lead in harassing Jonathan Martin, who left the team in October. They threatened to rape his sister, called him a long list of slurs and bullied him for not being "black enough." In a statement emailed by a league spokesman, the NFL did not make any mention of possible punishment stemming from the case. The league only confirmed it had received the report and said it appreciated the Dolphins co-operation with the investigation. Wells said he does not intend to comment further. Martin is biracial, Incognito is white, and Jerry and Pouncey are black. Martins agent Kenneth Zuckerman said his client feels "vindicated" by the report. "He feels a great sense of relief," Zuckerman told The Associated Press. "Jonathan Martin is a great man and hes only shown me that he is very honest since the day I met him. He loves football and is eager to get back on the field, regardless of what team he plays for." Incognitos attorney, Mark Schamel, released a statement calling Wells report "replete with errors" and said that Martin "was never bullied by Richie Incognito or any member of the Dolphins offensive line." Incognito sent a tweet Friday night, saying: "You could not define me in 144 years let alone 144 pages Mr Wells. Thank you for your hard work and dedication." Martin, who has two years left on his contract with the Dolphins, declined interview requests. Incognito was suspended in November, but Pouncey and Jerry remained starters throughout the season. The report mentioned another offensive lineman and an assistant trainer who also routinely came under attack from the trio. Neither was identified in the report. The report chronicled Martins struggle to deal with a "pattern of harassment," including emotional text exchanges with his parents and a description of him crying in the bathroom after one particularly painful attack. The report comes about three months after the league hired Wells to investigate the case, which prompted a national debate about hazing and workplace bullying. "To a great extent, Incognito dictated the culture," the report said. "We doubt that matters would have gotten so out of hand had Incognito not set a tone on the offensive line that made extremely vulgar taunting a typical form of communication." Dolphins offensive line coach Jim Turner didnt attempt to stop the behaviour and even took part in some of the taunting of "Player A," the report said. Several people interviewed told investigators that Turner gave Player A, a male sex doll as a gag gift around Christmas 2012. Turner told investigators he did not remember the incident, but investigators said they did not believe him. However, the report found no evidence that the Dolphins front office or head coach Joe Philbin was aware of the conduct Martin found abusive. The 6-foot-5, 312-pound Martin abruptly left the team Oct. 28. He was briefly hospitalized and then joined his family in California and underwent counselling for emotional issues. Incognito was barred from the seasons last eight games. Incognito expressed regrets about the racist and profane language he used with Martin, but said it stemmed from a culture of locker-room "brotherhood," not bullying. Martin has said he tried to be friends with Incognito. The two players traded more than a thousand text messages in a years span, and the teasing and vulgar banter went both ways. Martin also participated in the teasing of Player A, although investigators say he was simply trying to fit in with the other linemen. The report also mentioned Martin having suicidal thoughts. "Whether or not Incognito, Jerry and Pouncey fully appreciated the effect of their actions on Martin, there is no doubt that, from Martins perspective, their actions were abusive and hurtful," the report said. "We are not, however, in a position to evaluate Martins assertion that the abusive conduct of his teammates was, in fact, the exclusive triggering cause of his depression and contemplation of suicide." The NFL Players Association said it will review the findings closely, confer with players and all relevant parties involved. PHILADELPHIA – Like the rest of his teammates, Carl Gunnarsson was doing what he could to remain positive after yet another loss, the seventh straight for the sinking Leafs, but it wasnt easy. Chris Neild . The 27-year-old wants to believe that a turnaround is still possible, that his team can salvage the season, dig out from a deepening slide and claim a second straight playoff berth. But as time ticks down and the results continue to linger in the wrong direction, that belief is tested.   "Its a struggle," he said in a near-empty visitors dressing room at Wells Fargo Center. "Ill tell you that. We thought we had something going here tonight." Whatever fight they mustered in a 4-2 loss to the Flyers didt matter by the time the night was through. It was just another empty loss, another opportunity to regain ground for not. "Overall, I didnt think that we had that bad of a night," said coach Randy Carlyle afterward, but we were on the wrong side of the score and thats what counts the most." Never more evident than at this late stage in the season, the difference between winning and losing remained painfully thin. And for the Leafs it was just enough for defeat. Two power-play goals against, a few too many odd-man rushes, a bad break or two and a key mistake at the wrong time.  Claude Giroux was the benefactor of one such mistake that sealed defeat for the visitors. The Flyers captain picked off former teammate James van Riemsdyks neutral ice pass attempt - the puck ricocheted off the skate of Scott Hartnell - and zipped a bullet beyond the glove of Jonathan Bernier. "Right now every big scoring chance they get, I think it feels like its going in," said Bernier afterward. "When its not going your way, thats usually what happens." "I thought we played pretty good," he continued. "A few mistakes that end up being goals. From the last game, obviously, I think we played a lot better." But like their harrowing loss to the St. Louis Blues on Tuesday, one that saw them manhandled for half the game by the top team in the West, Fridays defeat in Philly counted all the same. It was just another loss at a critical point in the season. "We worked hard," Carlyle said. "Did we work smart enough in some areas? No." Any chance the Leafs have at resuscitation starts Saturday night in a massive showdown with the Detroit Red Wings. A victory reignites whatever belief and hope still lingers. They may have no hope of catching either the Montreal Canadiens or Tampa Bay Lightning, but sitting on near-equal ground with the Columbus Blue Jackets, Red Wings and Washington Capitals - all have 80 points, but with games in hand - a wild card position is still in play. "Obviously, this one, its going to be a tough one to swallow," Bernier said. "But, at the same time, we cant feel sorry for ourselves. [Saturday] is a big game and we all know that." Five Points 1. Carlyles Approach Carlyle has tried to push a few different buttons in midst of his teams recent slide. "Some days, it is a little bit more harsh. Some days, its a pat in the back. Some days its a hug," Carlyle said on Friday morning. "Whatever it is, whatever you feel is necessary. Nobody in life feels like coming to work and being ground into the dirt everyday and thats part of the process. Youve got to pick and choose when to apply pressure and when not to." As to his preferred approach of late, Carlyle said, "Its been more reality of the situation. Just showing and trying to get an understanding that were not that far away. But there are some areas that need to be addressed. Thats as simple as I can put it. Our compete level has to go up. We havent won enough one-on-one battles. Weve given up too many odd-man rushes and breakaways. Weve got to play better on the defensive side of the game." 2. Penalty Kill The Flyers scored twice on the power play, marking the 12th time this season that the Leaf penalty kill has given up two goals in a game this season. Vincent Lecavalier fired a laser for the first of two, a five-on-three goal that was not without some controversy. Jay McClement, taking the draw as Torontos lone forward, was thrown out of the face-off circle, charged with knocking the puck from the hand of linesman Michel Cormier. Dion Phaneuf promptly stepped in and lost the first (and likely last) face-off of his career, Lecavalier blowing the one-timer by Bernier just three seconds later. "Thats not something that you want to happen," McClement said of the face-off incident. "I dont think [Cormier] wanted to do it either. But he explained to me that its black and white when I knocked it out of his hand." Scott Hartnell would add the second power-play marker, redirecting a Kimmo Timonen point shot just beyond the grasp of Bernier. The Toronto penalty kill remains third-worst in the NHL this season. 3. Bollands Comeback Dave Bolland scored for the third time this season in Philadelphia and the first time since his left ankle was sliced by the skate of Zack Kassian on November 2. The 27-year-old hasnt played more than 13 minutes since he returned from the injury and he was kept right in that region against the Flyers. "I just see that in some of the situations, hes struggled with the mobility," Carlyle said of Bolland before the 4-2 loss. "Its not sore, [but] it just doesnt have the strength there. Wre going to try to find a way to get him some more minutes. We know what kind of player he is." 4. The 18-Wheeler Luke Schenn was there in 2012 when the Leafs collapsed and knows all too well how quickly the pressure rises in Toronto. "Lose a couple in a row and everything magnifies that much more," he said. "You lose three in a row and people tend to get on you a little bit. All the fans and the media think that everythings falling apart. Thats just the way it is over there. "Its obviously a tough market to play in when things arent going the way you want them to, but its a great market when things are going well. Theres always adversity in Toronto. Its never going to change. Im sure those guys are going to get through it." Reflecting back to the infamous 18-wheeler skid two years earlier, Schenn couldnt put his finger on just what wrong. "There is no exact reason why. Its probably a combination of different things. Id have to go back and look. Obviously, youre probably getting off to some tough starts in games. Special teams probably werent as good as they need to be. At the end of the day - when I was there - it probably just came down to being outcompeted some nights. Obviously, you lose a couple in a row, confidence isnt always there. Thats just the way it goes. Youve got to find ways to get out of it." 5. Gardiner Offence Just ahead of a clash with the Flyers three weeks ago, Jake Gardiner revealed his disappointment with the offence hed put together to that point. "I dont think my point production has been that great this year,"he said. "Id like to improve on that." The 23-year-old scored a goal the next night in a 4-3 overtime win, rounding up nine points in the past 11 games, including a helper on Bollands seventh goal this season. "Ive tried to jump in the play a lot more and be an offensive threat from the blue line," he explained of his recent surge prior to the game. FIVE QUICK NBA THOUGHTS 1. Robert Griffin III . STEVE NASH and STEVE BLAKE (Lakers): Both players are back in the lineup Tuesday against the Timberwolves. Blake had played quite well before he went down and, fingers crossed, Nash (who turns 40 on Friday - Happy Birthday!) tries to see if he can play through Back pain and finish the season. This Lakers season has not gone well with the loss of Dwight Howard, the injury to Kobe Bryant, and of course injuries to Blake and Nash. At the end of the day, this is a franchise that doesnt deal well with losing seasons yet it might be a time to re-invent themselves for the long haul. How these two guys hold up will give them better insight into where things are headed, at least short term, in their backcourt. 2. PAUL GASOL (Lakers): Speaking of this franchise, I think this ship has sailed here. If you can get cap space, luxury tax relief and/or a draft pick, you move him. He still has value, yet I see it diminishing despite him averaging close to 20 points and 12 rebounds a game in January. There is a lot of chatter about the Phoenix Suns making a run at him. Itll be interesting to watch it unfold but bottom line, it would be best for Gasol and the Lakers for him to have a change of scenery. 3. GREG MONROE (Pistons): There are rumblings from the Motor City that they need to look long and hard at what to do with this guy. I really like his game. When given the proper system and supporting players, I feel he has the attributes to help you win. Is he a franchise guy? No, but a very good player? Yes. Hes a positive building piece. I dont see how he can co-exist long-term with Josh Smith and Andre Drummond. Im not a huge Smith fan, nor am I big on the Brandon Jennings bandwagon. These are guys that will get you numbers but Im not sure if they understand what it takes to win on a nightly basis. Monroe can score in the post and has a solid face up game, he can really pass it and his rebounding and lane presence is sound. The Pistons need to figure out what their identity is because right now I see a team with a lot of parts yet with no semblance of the whole in mind. This is a team sport and when I watch them they dont look like one. Monroe is one of the few guys that gets how to play the team game. 4. RAPTORS at KINGS: Youll hear all the coach and player speak about it being ‘just another game. I dont buy it for one minute. Any time someone trades you, to some degree theyve given up on you and think they can do better with someone else, thats the reality of sports. The Raptors have benefited greatly with the acquisition of the Sacramento Four while Rudy Gay has played quite well for the Kings. Good for both sides. I expect a very intense game here tomorrow night in Sac-town. Cant wait. My Super Bowl Sunday in Seattle was a total blast. A few quick observations: First, for the Raptors game in Portland, it was a wonderful turnout of Raptor fans from Vancouver area who made the drive over. Awesome support! And secondly, what a joke that an amazing sports town like Seattle doesnt have an NBA team right now. Everywhere I went I saw not only 12th Man signs for the Seahawks but Bring Back our Sonics signs. I couldnt agree more. And finally, once again, I ran into a ton of folks from Vancouver, this time while I was in Seattle. Fun time watching the football game with them and their passion for hoops as well.  Ive said it a thousand times before and Ill say it again, weve got to get a team back in Vancouver as well.
